Recently, the Court of Justice of the State of São Paulo updated the Statements of the Group of Reserved Chambers of Business Law, including three new statements related to judicial recovery.
Check out the main points:
- Statement XXIV: Receivables transferred in trust (present or future) are not affected by the judicial recovery process.
- Statement XXV: Extra-bankruptcy creditors cannot include their credits in the judicial recovery, even if they want to and the company agrees. They must seek payment in specific lawsuits in court.
- Statement XXVI: Late (out of time) objections do not require payment of legal costs, based on the principle of strict legality.
These statements aim to offer clear guidelines for complex issues in business law, helping lawyers, judges and other professionals to make more consistent and fair decisions in cases of judicial recovery.
