TJSP decision recognizes validity of digitally signed credit instruments outside ICP Brasil standards

The 24th Private Law Chamber of the TJSP decided that it is no longer mandatory to use the ICP-Brasil digital certificate to sign credit instruments.


The decision recognized the validity of the digital signature made through links sent to the signatory, as long as the authorship and integrity of the document are proven.


The rapporteur of the appeal, Judge Rodolfo Pellizari, argued that the use of electronic documents is permitted in accordance with the specific legislation of the CPC. The decision was taken unanimously.
