Law 14,711/2023, which establishes the Legal Framework for guarantees, was published on 10/30/2023.
This Law amends Law No. 10,406 of January 10, 2002 (Civil Code), Law No. 9,514 of November 20, 1997, which provides for the Real Estate Financing System (SFI) and institutes the fiduciary alienation of real estate, and Law No. 8,935 of November 18, 1994, which provides for notary and registration services, among others.
Purpose of the Law
The changes and innovations aim to provide leverage and sustainability of credit at a national level, improve the efficiency of guarantees offered on the market, reduce risks related to default and make credit recovery more efficient.
Validity
The law comes into force on the date of its publication, starting 10/30/2023.
